The Civil Law Court of Montserrado County has ruled in favor of the Intestate Estate of Martha Stubblefield Bernard, ordering the eviction of the Congress for Democratic Change (CDC) from a 4.23-acre property located near Bernard’s Beach in Monrovia.
The decision, delivered on August 4, 2025, by Judge George W. Smith, was followed by the issuance of a Writ of Possession on August 13, officially declaring the estate as the rightful owner of the disputed land.
To enforce the court’s ruling, the Sheriff of Montserrado County, with support from armed officers of the Liberia National Police, has been authorized to execute the eviction.
The property, situated at the southeastern intersection of Tubman Boulevard and the road leading to Bernard’s Beach, has been the subject of a protracted legal dispute.
The estate claimed that the CDC had unlawfully occupied the land.
The court upheld the estate’s claim based on verified land deeds and well-defined boundaries.
In a formal letter to Police Inspector General Col. Gregory O. W. Coleman, the Clerk of Court requested police assistance to ensure that the eviction is carried out peacefully and in accordance with the law.
This ruling underscores the ongoing challenges surrounding land rights in Liberia and highlights the judiciary’s role in protecting legal ownership, even in cases involving influential political actors.
Legal observers believe the decision could set an important precedent for future land disputes, particularly those involving politically connected parties.
