Supreme Court To Hear Boakai’s Appointment Power on Assets Recovery Team

This Thursday, the Supreme Court of Liberia will witness a pivotal showdown as it deliberates on the legality of President Joseph N. Boakai’s Executive Order No. 126, which birthed the contentious Asset Recovery and Property Retrieval Office.

The courtroom clash stems from Gracious Ride’s persistent challenge against the constitutionality of the presidentially-appointed committee entrusted with uncovering ill-gotten gains which is a task ostensibly belonging to the Liberia Anti-Corruption Commission (LACC).

The LACC, resurrected by legislative decree in 2022, was imbued with a dual mandate which is to investigate and prosecute corruption while educating the populace on its perils and the dividends of its eradication.

Bolstered by direct prosecutorial powers, the LACC aimed to scrutinize cases implicating alleged corruption perpetrators rigorously.

Gracious Ride’s latest salvo in this legal saga involved a direct appeal to Justice Yusuf D. Kaba, contesting the legitimacy of the appointed committee.

Their argument pivoted on the premise that the President lacked the authority to assemble such a team, hence calling for its dissolution.

However, Justice Kaba’s initial dismissal of their appeal propelled Gracious Ride to escalate the dispute to the full bench of the Supreme Court.

At the heart of the matter lies Gracious Ride’s alleged acquisition of vehicles through dubious means, a claim prompting their challenge against the Asset Recovery team’s operations.

Yet, the government’s response has been steadfast relatively insisting on the legality of the Executive Order under Liberia’s constitutional framework.

They assert that the President’s prerogative to issue such orders is firmly grounded in the constitutional provisions aimed at curbing misappropriation of state resources and combatting corruption.

In their defense, the Ministry of Justice and the LACC have underscored procedural lapses in Gracious Ride’s petition, emphasizing the petitioner’s failure to cite specific legal violations within pertinent statutes.

This procedural misstep, they argue, underscores Gracious Ride’s lack of standing to challenge the Executive Order before the highest court.

While the legal jousting intensifies, the Supreme Court anticipates a rigorous exchange of legal arguments this Thursday.

Both sides are poised to make their case, underscoring the broader implications for executive authority, anti-corruption measures, and judicial oversight in Liberia.

This high-stakes legal spectacle underscores not only the clash between private enterprise and state authority but also the pivotal role of constitutional interpretation in shaping Liberia’s governance landscape.
