Judge Barca of the Monrovia City Court has denied the admissibility of video evidence in the ongoing trial of Kindness Wilson, citing a lack of authentication and credibility.
This decision means that the video, which went viral on social media, will not be considered as evidence in the case. As a result, the prosecution is now required to rely solely on eyewitness testimony, if necessary, to support their claims.
The decision followed an objection raised last Tuesday by Defense Counsel, Atty. Jeremiah Samuel Dugbo I, who challenged the introduction of the video footage presented by Prosecution Lawyer, Cllr. Moriah Yeakula. Atty. Dugbo argued that the footage was self-serving and illegally obtained.
While acknowledging that video evidence is generally admissible in court, Judge Barca stressed that such evidence must first meet the legal standard of credibility, a burden the prosecution failed to satisfy.
