The Monrovia City Magisterial Court has dismissed all criminal charges filed against Allen R. Brown Jr., Chief Executive Officer of Urban Marketing Group Inc., citing the prosecution’s failure to diligently pursue the case within the time limits prescribed by law.
The ruling, delivered on January 20, 2026, effectively ends a criminal complaint initiated in September 2025 by private prosecutors acting on behalf of the intestate estate of the late Hilary Tubman, represented by Abdurahman Barry, Michael Morgan, and Rebecca Tubman.
Charges Thrown Out for Lack of Prosecution
Mr. Brown had been accused of criminal trespass, criminal mischief, felonious restraint, criminal conspiracy, and criminal facilitation. However, despite the matter being placed under the jurisdiction of the Magisterial Court, the case was never advanced to trial and no evidence was presented.
According to court documents obtained by this publication, defense counsel from Jones & Jones Law Offices, led by Cllr. Molley N. Gray Jr., argued that the case had exceeded the 30-day statutory period allowed for criminal matters before a Magisterial Court under Rule Nine of the Rules Governing Magisterial Courts.
The defense maintained that the prolonged inaction amounted to a waiver by the prosecution and constituted an abuse of judicial process, resulting in the unjust restriction of Mr. Brown’s liberty.
Prosecution Raises No Objection
In a notable development, lawyers representing the Ministry of Justice, including City Solicitors Alex Hawkins Young, Varfley C. Kulee, and Alfred F. Bandiyo, did not oppose the defense motion. Instead, the prosecution requested that the court dismiss the case without prejudice, conceding that no testimony or evidence had been heard.
Court Warns Against Judicial Harassment
In his ruling, Stipendiary Magistrate L. Ben Barco strongly criticized the continued listing of the case without substantive action, describing it as inconsistent with the law.
“The court must not be used as a tool to harass a defendant under the guise of seeking justice,” Magistrate Barco stated.
The court subsequently granted the defense application, dismissed all charges, and ordered the immediate restoration of Mr. Brown’s liberty and legal rights.
Clerk’s Certificate Confirms Decision
A Clerk’s Certificate issued by Abel Kaley, Clerk of the Monrovia City Court, formally confirms that the case was dismissed due to the prosecution’s failure to proceed since filing. The certificate further affirms that all restrictions previously imposed on Mr. Brown as a result of the case have been lifted.
With the case now officially closed, Allen R. Brown Jr. is free to resume his personal and professional engagements without any legal impediment stemming from the dismissed charges.
