Supreme Court Dismisses Appeal in Allen Brown Case, Orders Enforcement of Trial Court Judgment

The Supreme Court of Liberia has dismissed an appeal in the Allen Brown case after finding that the respondents failed to meet the legal requirements necessary to complete their appeal.

The case arose from a declaratory judgment action in which Urban Marketing secured a final judgment from the trial court on November 28, 2025.

The respondents later challenged the ruling and asked the trial court to rescind the judgment. However, the Supreme Court found that the trial judge had already approved their bill of exceptions before attempting to set aside the earlier decision.

The Supreme Court said that while a trial judge may rescind or modify a judgment during the same term of court in which it was entered, that authority ends once a bill of exceptions has been approved.

According to the Court, the approval of the bill of exceptions removes the case from the trial court’s jurisdiction, except for limited actions connected to the appeal.

The Court also found that the respondents failed to file an appeal bond and did not properly serve and file notices of the completion of the appeal as required by law.

The Supreme Court said those failures were sufficient grounds to dismiss the appeal under Liberia’s Civil Procedure Law.

The decision leaves the trial court’s November 28, 2025 judgment in favor of Urban Marketing in force.

The Supreme Court therefore granted the motion to dismiss the appeal and ordered its Clerk to send a mandate to the trial court.

The mandate directs the presiding judge to resume jurisdiction over the matter and take the necessary steps to enforce the judgment.
