Former District #10 Representative Yekeh Kolubah has suffered a legal setback after Associate Justice in Chambers Yussif D. Kaba denied and dismissed his Bill of Information filed before the Supreme Court of Liberia.
In his ruling, Justice Kaba stated that the writ of prohibition and accompanying stay order were not properly served on the Respondent in keeping with Rule 26.5 of the House of Representatives.
“In view of the foregoing, this Court finds that the writ of prohibition and accompanying Stay Order were not properly served upon the Respondent consistent with Rule 26.5 of the Rules of the House of Representatives,” Justice Kaba ruled.
The Justice further noted that the Respondent could not be held in contempt for actions taken without lawful service of the court’s orders.
“Wherefore, and in view of the foregoing, the bill of information is hereby denied and dismissed for lack of proper service,” the ruling added.
The decision represents another legal challenge for Kolubah, who has been battling his removal from the House of Representatives.
However, lawyers representing the former lawmaker have vowed to challenge Justice Kaba’s ruling before the full bench of the Supreme Court.
The latest development leaves uncertainty surrounding Kolubah’s political future and whether his expulsion from the Legislature will ultimately stand.
